Is this a merlin?

Seen today in Ladner harbour park, they were holding tight to this tree as crows tried to move them

The malar stripe is too large for a merlin. Please consider immature Peregrine Falcon.

I had another look and yes, now favouring juvenile Peregrine Falcon. Thanks!
Can't always been right.

I was not able to gauge size from the photo. For comparison, the bird does look similar to an Adult Merlin (black) subspecies that we also have here on the coast.

Peregrine is a Peale's the large darker race of the peregrine's ( tundra, anatum and peale's) They have number's in the Queen Charlotte with established nesting pairs. good photo.
